Since the current PERM regulations took effect on March 28, 2005, the Labor Certification process must be filed through the PERM system, which is a completely new process distinct from previous labor certification application process. Though the PERM system follows most of the same fundamental rules as the old process, the procedures have been changed substantially. Moreover, the recruitment process in the PERM procedure is more complicated than pre-PERM recruitment. PERM poses a series of tremendous challenges including maintaining a high degree of familiarity with the fundamentals of the labor certification rules, expertise in the technicalities of the PERM form, and experience in PERM strategy planning in a short period of time.

Long before the DOL’s adoption of the PERM regulations, our firm had established a PERM task force to closely follow and study several draft versions of the new regulations. Since the finalization of the PERM regulations, the firm’s PERM specialty team has taken on many legal and procedural challenges and became one of the first immigration law firms to have PERM cases approved.
