The Limitations of TN Status

1. SHORT DURATION:
TN status has a maximum period of validity of three year. It may be renewed indefinitely, but it must be done every three years.

2. IMMIGRATION PETITION CAN BE A BAR:
A pending application for permanent residence can be the basis of denial of TN Status. In this respect it is unlike H-1B status wherein the alien may have dual intent without an adverse affect to the alien's non-immigrant or immigrant petition.

3. SPOUSE AND CHILDREN NOT AUTHORIZED TO WORK:
Unless specifically authorized, TN dependents (TD) are not allowed to work.
